⚠ The Cost of Non-Compliance

One Rejected Shipment Can Cost More Than a Year of Revenue

The FDA has broad authority to detain, refuse entry, or destroy non-compliant food imports. For specialty food importers, a single compliance failure can be catastrophic — before the first sale is ever made.

$50K–$150K Typical loss per rejected shipment
30–90 days FDA hold times on detained imports
$1,000/day Civil penalties for FSVP violations

What Is FSVP?

The Foreign Supplier Verification
Program — Explained Simply

FSVP is an FDA regulation requiring US food importers to verify that their foreign suppliers produce food in a manner that provides the same level of public health protection as US facilities. Non-compliance puts your import license at risk.

🔬
Hazard Analysis
You must conduct a documented hazard analysis for each food product and foreign supplier — identifying known or reasonably foreseeable biological, chemical, and physical hazards.
🏭
Supplier Verification
For each hazard, you must conduct appropriate supplier verification activities — including supplier audits, sampling/testing, or review of the supplier's food safety records.
📋
Documentation Records
All FSVP records must be maintained for 2+ years and be available to the FDA within 24 hours of a request. Missing records are treated the same as non-compliance.
📦
Prior Notice
FDA Prior Notice is required for all food imports before they arrive at the US port of entry. Late or missing prior notice can result in immediate shipment detention.
🏢
Facility Registration
Foreign facilities that manufacture, process, pack, or hold food for US consumption must be registered with the FDA and renew registration every two years.
🔄
Annual Review
FSVP requires periodic reassessment of your hazard analysis and supplier verification activities — at least annually, or whenever material changes occur.
